Randolph argues that the original court system, established by Congress with the Judiciary Act of 1789, does not allow for enough Federal power over the State courts on specific issues, and that circuit riding, i.e. Supreme Court Justices serving on circuit courts, creates a conflict of interest wherein the same justices are hearing both the cases and the appeals.
